A Langley Township councillor is suing the Otter Co-op after he was allegedly injured at one of their gas stations earlier this year.
Councillor Rob Rindt’s legal claim was filed in B.C. Supreme Court in Abbotsford on June 5. The Otter Co-op has not yet filed a response.
According to the statement of claim filed by Rindt’s lawyer, he was injured on March 25 in the Co-op gas bar on Ladner Trunk Road in Delta.
Rindt went in to buy a lottery ticket.
“When leaving the store, the plaintiff struck his head on a metal piece of the door that was hanging down, causing injury and damages,” the statement alleges.
He suffered a concussion, neck injury, and back injury due to the incident, the statement says.
The injuries have impacted his income and ability to earn an income in the future, the statement continues, although details of the financial impacts were not laid out in full in the initial claim.
There is also an impact to his ability to continue to care for himself and his family in his domestic chores, the claim says.
Rindt is also suing for possible future care costs, pain and suffering, sleep disturbance, and “loss of enjoyment of life and the inability to participate in several of his recreational pleasures, past and future.”
He alleges the Co-op was negligent, leading to the incident.
There was no suggested dollar value for damages.
None of the allegations in the statement of claim have been tested in a court of law.
The Langley Advance Times reached out to the Otter Co-op. but the company declined to comment on a matter before the courts. The Advance Times also reached out to Rindt but did not receive a response before publication.
The Otter Co-op, with its head offices within the Township, was founded as the Otter District Farmers Institute in 1922, and in the 1930s began supplying feed to local farmers and running a general store. It now has multiple outlets including gas stations, liquor stores, and grocery outlets.
